1. GENERAL

Welcome to nauaa.com. All purchases of our handcrafted British and American aircraft weathervanes are governed by the terms set out below (this “Agreement”). We reserve the right to revise these Terms at any time, with changes taking effect immediately upon publication on our website. We recommend reviewing this page each time you shop to confirm the current applicable terms. We may adjust, update or remove site content at our sole discretion without prior notice.

To place orders and use our website, you must be at least 18 years of age. Any access, browsing or use of this site confirms your full acceptance of this Agreement. If you disagree with any clause within these Terms, you must stop using our website immediately. Please read this Agreement thoroughly before completing any purchase.

We encourage you to review our Privacy Policy to understand how we collect and store your personal information. We may send email updates to notify you of site updates, new British & American aircraft weathervane designs, promotions or service changes. 2. USE OF OUR WEBSITE

When using our website, you confirm all personal and shipping details you submit are truthful, complete and accurate. You warrant you are aged 18 or older; if you are under 18, you may only browse and shop with direct supervision from a parent or legal guardian.

Subject to this Agreement, we grant you a limited, revocable, non-transferable, non-exclusive license to view and browse our website for personal shopping purposes only. You may not use this site, its images, text or aircraft design files for commercial resale, third-party business or any unapproved purpose without our prior written consent. Any breach of these rules will result in immediate termination of your access license without prior notice.

You are prohibited from reproducing, distributing, editing, reverse-engineering, disassembling or creating derivative works from any British/American aircraft weathervane designs, product imagery or page code hosted on nauaa.com unless we provide formal written approval. All aviation craft designs featured on this site are original protected works; unauthorized commercial use of our site content is strictly forbidden.

We reserve the right to refuse service, suspend user accounts or cancel pending orders if we determine a customer’s conduct violates local laws or harms our business interests.

You may not upload or share content through our site that:

(a) Infringes copyright, trademarks, trade secrets or any third-party intellectual property rights;

(b) Contains defamatory, threatening, obscene, illegal or harassing material;

We may assign a unique account ID and password for your registered account. You are fully responsible for all activity completed under your login credentials, whether you personally authorized the action or not. You must secure your account login details confidentially, and notify us immediately if you detect unauthorized access to your account or any site security breach.

You are solely responsible for submitting accurate, complete shipping, consignee and payment information for customs and delivery processing in the UK or US. If incomplete or incorrect details cause delivery delays, lost parcels or customs clearance failures, we accept no liability and will not provide compensation for resulting losses. As the receiving importer, you are responsible for complying with all local customs, import tax and aviation goods regulations in your delivery region (United Kingdom or United States).

3. DATA & INFORMATION POLICY

When creating an account or submitting an order, you agree to provide valid, accurate contact and shipping details for UK or US delivery. We will only use this information to process your order, arrange delivery and resolve any post-purchase support issues.

Your personal privacy is a priority for us. Full details on data collection, storage and usage are outlined in our standalone Privacy Policy page, compliant with UK GDPR and US federal data privacy standards.

4. ORDER & PRICING ERRORS

You may update your personal information within the “My Account” section at any time. If you notice incorrect details during checkout, our page confirmation prompts will prevent order submission until all required fields are completed accurately. You may also review and adjust your cart contents, shipping address and order details before final payment.

If you spot errors in your order after payment has been processed, contact our support team right away via nauaacon@outlook.com to request corrections.

We make every effort to display accurate product descriptions and pricing for our UK & US aircraft weathervanes, but typographical or listing errors may occasionally occur. We do not confirm final pricing until your order is fully processed. If a product is listed at an incorrect price due to a system error, we reserve the right to cancel your order or reach out to you to confirm adjusted pricing before fulfillment.

5. TRADE RULES

5.1 Price & Payment

All displayed product prices include applicable local sales tax where required, valid at the time you view the listing. Delivery fees for UK or US shipments are calculated separately and added to your final order total. Prices are subject to change without notice, but confirmed orders with a formal order confirmation email will retain their original pricing.

After adding items to your cart, follow the checkout steps to submit your order and complete payment. Registered users can view their full order history within the “My Account” dashboard. Accepted payment methods include Visa, Mastercard, American Express, UnionPay and PayPal.

All payment card data is fully encrypted to prevent unauthorized access. When you place an order, we complete a pre-authorization check on your payment method to verify sufficient funds. Your card will only be charged once your order is dispatched from our warehouse.

By clicking “Authorise Payment”, you confirm the payment card belongs to you. If your card issuer declines the transaction, we cannot complete your order and accept no liability for delivery delays caused by failed payment authorization.

5.2 Product Color Disclaimer

We strive to match the on-screen display of each British and American aircraft weathervane’s metal finish and color as closely as possible. However, monitor display settings vary across devices, so we cannot guarantee an exact color match between your screen and the finished physical metal product.

5.3 Packaging

Standard protective packaging will be used for all UK and US bound orders to meet general shipping requirements. Any custom packaging, reinforcement or special handling requests you submit will incur additional fees payable by you.

5.4 Shipping & Delivery

We hold inventory across multiple warehouse locations. If your order contains multiple British/American aircraft weathervane items, we may split your shipment into separate packages based on stock availability at our discretion.

Our standard delivery window is 7 working days from order confirmation for both UK and US destinations. Delivery times may extend during peak seasonal periods. Saturdays and Sundays are not counted as working business days. If you have not received your goods after 10 working days, contact our support team at nauaacon@outlook.com to open a delivery investigation.

Regional Customs Note

Customers shipping to the United Kingdom or United States are fully responsible for all import duties, customs clearance fees and local tax charges levied by regional border authorities upon arrival. We do not cover any cross-border import levies for international shipments.

5.5 Risk & Ownership of Goods

United States Deliveries: Risk of loss or damage to products transfers to you once the parcel is handed over to our delivery carrier. Any damage claims sustained during transit must be submitted directly to the US shipping provider.
United Kingdom Deliveries: Risk of loss or damage remains with us until you take physical receipt of the parcel, in compliance with UK Consumer Contracts Regulations.

If you receive goods damaged or missing items before carrier handover, you must submit a claim to us within 14 days of delivery, alongside signed delivery documentation confirming the damaged condition upon receipt. Full legal ownership of all aircraft weathervane products remains with Nauaa until your full order payment has been cleared in full.

5.6 Returns & Exchanges (UK & US Separate Terms)

For UK Customers (Statutory 14-Day Cooling-Off Period)

Under UK consumer law, you hold a mandatory 14-day unconditional return window starting the day you receive your aircraft weathervane. You may return unused, undamaged items in original packaging for any reason within this window. We cover standard return shipping costs for valid cooling-off period returns.

We offer exchanges for sizing mismatches and manufacturing defects. If we confirm a product fault after receiving your returned item, we will issue a full refund covering both your original delivery charge and return shipping cost. Refunds will be processed either to your nauaa.com account store credit or your original payment method, per your request.

Custom engraved aircraft weathervanes are excluded from the 14-day cooling-off return right, as bespoke personalised goods fall outside standard UK consumer cancellation rules.

For US Customers

No federal mandatory cooling-off return period applies to US online orders. Our standard return window is 30 calendar days from delivery date. Customers are responsible for all outbound return shipping fees unless the item arrives defective or damaged due to our manufacturing error.

5.7 Customer Reviews & Submissions

All photos, videos, comments, feedback, aircraft design suggestions and other content you submit to our site (“Submissions”) are considered non-confidential. By posting Submissions, you grant us a permanent, royalty-free, worldwide license to use, edit, reproduce and share your content for business purposes without additional compensation. Your submitted content will become our exclusive property and will not be returned to you.

You guarantee all Submissions you post do not infringe third-party copyright or intellectual property rights, and you will cover any legal losses we incur from unauthorized content you upload. When posting reviews, you also authorize us to display your submitted name alongside your feedback on our website and social media channels. You may not use false identities or fake email addresses to submit misleading reviews. We reserve the right to remove or edit customer content at our discretion, with no obligation to notify the poster.

6. INTELLECTUAL PROPERTY RIGHTS

All website text, British & American aircraft weathervane designs, product photography, logos and brand trademarks are protected intellectual property owned exclusively by Nauaa or licensed for our sole use. You may only view and copy order-related information for your personal record-keeping; no commercial reproduction or redistribution of our original aviation craft designs is permitted without written approval. The “nauaa” brand name, logo and trademarks may not be used in external marketing or third-party listings without our formal consent.

7. THIRD-PARTY LINKS

Our website may include links to external third-party websites or social media platforms for your reference only. We have no control over external site content and take no responsibility for any loss or damage arising from your use of outside platforms.

8. FORCE MAJEURE

We will not be held liable for delays or unfulfilled orders caused by events outside our reasonable control (Force Majeure), including:

Labour strikes, industrial action or public protests
Civil unrest, conflict, terrorist activity or threat of war
Natural disasters including fire, flood, storm, earthquake and epidemic
Disruptions to air, sea, road or postal transport networks serving UK and US markets
Telecommunications service outages
Government legal restrictions, import bans or official regulatory actions in the United Kingdom or United States
Shipping carrier operational failures

Our contractual obligations will be suspended for the full duration of the Force Majeure event, with our delivery timeline extended to match the disruption period. We will take reasonable steps to resolve the situation and resume order fulfillment as quickly as possible.

9. LIABILITY LIMITATIONS

Our maximum financial liability for any aircraft weathervane purchased via our website is capped at the original purchase price of the item, except where liability cannot be legally excluded:

Injury or death caused directly by our negligence
Fraud or deliberate misrepresentation
Any scenario where limiting liability violates UK Consumer Rights Act or US federal consumer protection law

To the full extent permitted by law, we accept no liability for indirect losses including lost revenue, business profits, missed contracts, corrupted data or wasted administrative time.

We do not guarantee uninterrupted, error-free website performance, secure digital data transmission or 100% accurate site content. All aircraft weathervane products are sold “as described”, with no implied warranties beyond mandatory legal consumer protection rights in the UK and US. We guarantee all goods will match the descriptions shown on our site, function as standard aviation weathervanes and meet the reasonable quality standards expected for handcrafted metal decor.

10. GOVERNING LAW & DISPUTE RESOLUTION

For UK Customers

Contracts formed with customers based in the United Kingdom are governed by the laws of England and Wales. Any disputes will first be resolved via negotiation with our 24-hour support team; unresolved disputes may be submitted to UK small claims mediation services.

For US Customers

Contracts formed with customers based in the United States are governed by the applicable federal and state consumer laws of the delivery address. Any disputes will first be resolved via negotiation with our 24-hour support team; unresolved disputes may be submitted to local small claims courts in the buyer’s US state of residence.

11. SEVERABILITY

If any single clause within these Terms & Conditions is ruled unenforceable by a UK or US court, all remaining provisions shall remain fully valid and binding between both parties. This Agreement, together with our Privacy Policy, Shipping Policy and Return & Refund Policy, constitutes the full binding contract between Nauaa and all customers.
